Mark Cohen, a former teacher, is seeking class action status for his lawsuit against Chicago Public Schools. His suit alleges that the mistake violated state law and privacy rights. One of Cohen's attorneys, Robert Holstein, said identity thieves could have retrieved the information from victims' garbage cans. "You don't think there's thieves out there looking for stuff like this at Christmas time?" Holstein asked. "It's a disaster." Also named as a defendant in the lawsuit is the contractor being blamed for the mistake, All Printing & Graphics Inc. of Broadview. The company was hired to print and mail a packet of health-insurance information to the former employees. CPS said the company mailed a spreadsheet used to make mailing labels, thinking it was a list of health-care providers. Ralph Fowlkes, general manager of All Printing & Graphics, has apologized for the mistake. But Cohen claims the error has left him and other former employees vulnerable to identity theft. The lawsuit alleges that Cohen and others already have been "irreparably injured" by having their private data sent "with reckless abandon to unauthorized persons." The suit asks that CPS establish an endowment fund to pay for financial losses and that it immediately stop distributing documents that contain Social Security numbers. Also Tuesday, Chicago Teachers Union President Marilyn Stewart sent a letter to Schools CEO Arne Duncan that called the mailing a "colossal blunder" that "shattered the peace of mind (retirees) should be experiencing."
